The application seeks approval for:
- 2-3 storey building, plus two basement levels (11.725m maximum height above natural ground level)
- total building floor area 10,980m² (39.8% site coverage)
- all buildings demolished except the 1941 church
- childcare centre (96 places)
- food and drink premises (café)
- medical centre (5 practitioners)
- restricted recreation facility (gym, swimming pool, splash park and wellness centre)
- place of assembly (gallery and events space)
- removal of vegetation (including 24 protected trees on site and 15 street trees)
- creation and removal of easements
- display of internally illuminated signage (12 signs across the site)
- vehicle access via King Street
- removal of existing crossovers to Lower Heidelberg Road
- 97 parking spaces and 36 bicycle parking spaces provided.

History
We refused an application (P1332/2018) for the development of the land for a residential aged care facility, use and development for medical centre and child care centre, the display of internally illuminated business identification signage, removal of vegetation under the vegetation protection overlay, removal and creation of easements and alteration of access to a road in a road zone (category 1) in September 2019.
The reasons for refusal included:
- proposal breaches restrictive covenants
- accumulation and scale of uses inconsistent with zone objectives
- hours of operation inappropriate for residential context
- intensity and scale of uses, including vehicle movements, have a detrimental impact on residential amenity
- scale, design and height of building does not make a positive contribution to the neighbourhood character
- inadequate space provided for canopy tree planting and landscaping
- height of building does not meet mandatory requirements in planning scheme.
An application was made to the Minister of Planning via the Victorian Government Development Facilitation Program (DFP) in 2021 for accelerated assessment and determination of the process.
This application was largely the same as the previous application refused by Council. We made a submission opposing both the proposed development and use and the use of the DFP to bypass consideration by Council. On 14 April 2022, the Minister advised us of the decision not to intervene.

A public information session will be held on Thursday 13 June 2024 at 5.30pm at Ivanhoe Library and Cultural Hub, 275 Upper Heidelberg Road (Wilim Ngarrgu Community Meeting Room 2).
Objections, submissions and next steps
Objections and other submissions regarding the proposed development can be made until 25 June 2024.
Objections and submissions received after this date may be accepted as long as they are made before a decision is made.
Our Development Planning Unit will review all objections and submissions made in relation to the proposed development. Should the proposed development be considered at a future Council meeting, all submitters will be notified prior it being considered.
