Regulation 116 for public protection

Regulation 116 report and consent for public protection is required when construction works will have an impact on a public area or a community asset.

You must get our consent if your building project is on public land and does not meet the requirements set out in the Building Regulations 2018.

Your relevant building surveyor (RBS) cannot issue a building permit to you unless they are satisfied that consent from us has been obtained.

Plans you will need

Written statement from the RBS

The RBS must detail and agree to the proposed methods of protection that will be erected over affected streets and public areas. This also must include acknowledgement with the appointed builder on the precaution arrangements and expectations.

The statement must include signed reference plans that show the protection work, for example signage and pedestrian clearances. The RBS will have these, or know where to source them.

Site plan

Your architect or draftsperson will have created a site plan. Be sure that your plan clearly shows the:

  • property with construction works and its relationship to footpaths and streets, noting the location of adjoining properties, trees, street signs and furniture.
  • length, width and area of the footpath, road or public space that is to be occupied by hoarding, scaffolding or gantry.
  • minimum dimensions of footpaths from the boundary line to the kerb
  • location of street furniture
  • width of streets adjacent to the proposed precaution
  • location and placement of public protection signage and protective measures, ramps and directional pedestrian signs
  • height and type of the hoarding that will be used
  • minimum pedestrian access clearance to be used adjacent to the hoarding perimeter
  • minimum unobstructed width and height clearance for obstructions to gantries.

Gantry and hoarding plan

Your architect or draftsperson will also have created a detailed plan for any gantry or hoarding. Detail must include the methods of support and should take into account the stability of the proposed gantry or hoarding.

Precautionary structural designs

Your application must include structural designs for any gantries, scaffolding and non-standard hoardings that will be erected over the footpath, street or public area.

You must show evidence of computations, calculations and a certificate of design. The RBS will have these, or know where to source them.

 

Steps to apply

Step 1.Check your project against Building Regulations 2018

Your RBS will assess your build and make a call if Regulation 116 public protection consent is required.

Step 2.Supporting documents

Collect your written RBS statement, site plan, gantry or hoarding detailed plan and all relevant precautionary structural designs.

Step 4.Assessment

Your application will be assessed within 4 weeks. This may take longer if we need to refer it to other reporting authorities, seek information from adjoining owners or if the information you provided was incomplete.

Step 5.Outcome

You will be advised of our decision via email.
