Works within road reserve consent

If you intend to conduct work on a footpath, road or on any Council land you will need consent to begin. Work may include the connection of new services such as water, gas, electricity, stormwater or to carry out the re-instatement of Council assets.

What is a road reserve?

The road reserve is the public land beyond your property boundary and includes footpaths, nature strip, drains, verge, shoulders and roadway.

The road reserve begins at the property boundary and includes the footpath, nature strip and trees, kerb and channel and road. Steps to apply

Step 1.Location

Understanding who manages the road reserve area is important to know.

We manage most of the local streets in Banyule, but not all. Some are managed by VicRoads.

If you are unsure about your area, contact the Municipal Laws and Public Assets team on 9490 4222 or consult VicRoads | Map of declared roads or call 13 11 71.

Step 2.VicRoads MOA

If VicRoads manages the road reserve you will working in, then you must first apply for a Memorandum of Authorisation (MoA) from VicRoads.

An MoA is not required for works taking place on Local Council managed road reserve.

Step 3.Traffic plan

A detailed traffic management plan must be developed by an accredited traffic management company. 

The plan must be site-specific and include clear detail and drawings of the proposed location of work and demonstrate how the public will be safely managed during work activities. Be sure it includes:

  • required changes to vehicle traffic into on-coming lanes
  • number and length of lanes to be closed
  • clearway operating hours
  • any affects to bridges and other structures
  • hours of work per day
  • impact on pedestrians and cyclists, including provision for people with accessibility requirements.

Step 4.Excavation site plan

All applications require an excavation site plan. Be sure to include:

  • location of proposed excavation
  • drawing of works within the road reserve
  • detail of all Council assets that will be affected.

Step 5.Certificate of currency

A copy of your valid Certificate of Currency for public liability (minimum $20,000,000) is required for the application. 

Step 6.Notification (if applicable)

Residents and businesses must be notified if the proposed works affect the ability to maintain vehicular or pedestrian access to their property.

Notification must be provided in writing and distributed in person or mail at least 7 days prior to work starting.

If applicable a copy of your notification must be submitted with you application.

Step 7.Fees and lodgement

An application and inspection fee will apply on lodgement. We will assess the application and provide a response to you within 10 working days.
Be advised a consent fee will applied and a bond may be required. This will be determined after the initial assessment or your application and must be paid prior to consent being issued.

Have a valid Visa or Mastercard ready for payment.

Step 9.Inspection

After receiving consent you will need to book an inspection with an Asset Protection Officer by contacting the Municipal Laws and Public Assets team on 9490 4222 or permits@banyule.vic.gov.au. Ensure you have the consent number and details of the inspection required so have your application handy.

Step 10.Reinstatement and completion of work

On completion of the work it is the responsibility of the works manager to ensure that:

  • council is notified of the completion of work and
  • reinstatement is carried out in accordance with Councils Standards and specifications.

All reinstatement is at the cost of the consent holder.
